At long last, the Land Use Board of Appeals (LUBA) will hold oral arguments on our appeal of Tillamook County’s decision to approve a massive riprap revetment at Pine Beach.  The hearing takes place on Tuesday, Aug. 23, at 1 p.m.  The public cannot participate, but can listen in.

Oregon Shores, joined by Surfrider, contends that the 15 properties in question, located just south of Rockaway Beach, are ineligible for shoreline armoring under Goal 18 (protecting beaches and dunes) of Oregon’s land use laws. The case has become notorious because the landowners didn't wait for the outcome of the appeal, and rushed ahead to install the riprap. For background on this very important land use case, go here.

Here are LUBA’s instructions for listening in to the hearing:

“If you would like to listen to an oral argument, please call 1-844-766-2282 and enter 620100 when asked for the Participant Code. LUBA requires that you place your phone on its “MUTE” setting when listening to an oral argument. It is extremely important that you adhere to this policy. Do not listen to oral argument on a phone that does not have a “MUTE” setting. If your listening by phone disrupts oral argument to the extent that LUBA determines it cannot hear the parties’ arguments and/or the parties cannot hear each other, LUBA will terminate the oral argument and deem the case submitted on the briefs.”
